These Terms set forth the terms and conditions under which you may use the Shopt website and services as offered by us. This website & our website services, offers users various services and products for purchase. By accessing or using the website or our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. You as the signing party, whether an individual; business owner or business representative, must read all the terms prior to signing a contract with us. All services and features offered by Shopt are listed on the website, as well as any new features added subsequently. We reserve the right to amend, update or change the Terms of Use at any time. 

Privacy Policy

All information and clauses related to how we handle your & your customers privacy and your website information can be found in our Privacy Policy: https://packages.shopt.co.za/privacy-policy. We are POPIA Act compliant. The private information required for executing the orders placed through the e-commerce facility, namely the user’s personal information and credit card details, delivery address and telephone numbers, will be kept in the strictest confidence and will not be sold, rented  or made known to any third parties. Only the necessary information – i.e. the delivery address and contact phone number - will be made known to third parties delivering the product. Credit card details will not be kept under any circumstances.

This site uses cookies for important reasons, such as: to provide a good experience for visitors and customers, to identify our registered members (users who have registered on our site), to monitor and analyse the performance, operation and effectiveness of our website platform, and to ensure our platform is secure and safe to use.

Our Offering

Shopt is an E-commerce & brochure website system offering a simple to use and locally supported content management system. This means that you will get a front end, customer facing website together with a backend admin portal where you can manage your websites and/or online shops information. We charge a fee for our services, this is broken down into i) Once off Activation Fee ii) Monthly Package fee iii) Monthly % Transaction fee. 
All the various features available on the different packages are available here on our website. 
Our set up service includes a 1 hour online training session to give you control over your website. We also offer free continued re-training and system information clarification. For additional content generation or product loading please enquire and a fee may be charged.

PLEASE NOTE : the service offering is a system set-up and monthly rental including content population, this DOES NOT INCLUDE on-going marketing for example: social media marketing | digital marketing | bulk email send-outs | google business manager | google ad-words 
and does not include BRAND CREATION for example : logo | brand colours | font guide etc.

Return and refund policy

We offer non-physical services therefore do not deal in returned items. Our e-commerce or brochure website services can be cancelled with a 1 (one) month notice given at anytime after the once off activation fee is paid. This activation fee is non-refundable.

Retention of right to change offering

We may, without prior notice, change the services or products; stop providing the services or products we offer; or create limits for the services or products. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Warranties & responsibility for services and products

We agrees to supply set up, limited product population and on-going support for the Shopt system/s to the client. 
The Shopt working hours are South African industry standard office hours between 8:00am to 17:00pm, Monday to Friday. Only in the  
case of a live website not displaying online, will after hours support be available.
Client responsibility includes, but is not limited to, providing website content; product information; imagery; addressing general 
queries and 3rd party account information in a timeous and organized manner, especially during the website set-up stage.
Client needs to provide bulk of the website Content at the set-up stage. On request, Shopt can provide imagery and text content for basic pages. Both parties agree to use email as the main channel of communication with content uploadable to a shared online drive. Both parties
will  conduct the business relationship in a professional and courteous manner at all times. Shopt support team will notify the client of
required information/content via checklist/s. 

Ownership of intellectual property, copyrights and logos

Shopt exclusively owns the code base that forms the structures of the content management system branded Shopt and all subsequent code packages related to it, as well as existing Shopt website systems or modules that may be used within it. 
The Client owns all materials pre-populated and subsequently generated into the website as well as any proprietary product information. Materials can include: customer information; product based information including imagery; sales information and blog/news content created on the website. On termination of this contract, the Client has no right to copy/remove/re-use the code or system. The client can retain or export all populated material as mentioned here.

Indemnification

You agree to indemnify and hold the company harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, we assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices – please just notify us at any time.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws prevailing in the Republic of South Africa without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the Western Cape in the city of Cape Town. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
